Terms of Use & End User Licence Agreement.

Please read this End User Licence Agreement & Terms of Use (“Agreement”, “Terms”) carefully before downloading, installing, or using the easySED mobile application (“Application”, “App”, “Service”) operated by Jorge Andrews, trading as easySED (“us”, “we”, or “our”).

By downloading, accessing, or using easySED, you (“User”, “you”) agree to be bound by the terms of this Agreement. If you do not agree to these terms, do not download, install, or use the Application.

We grant you a revocable, non-exclusive, non-transferable, limited licence to download, install, and use easySED solely for your personal, non-commercial use on any Apple-branded products that you own or control, in accordance with the Usage Rules set forth in the Apple Media Services Terms and Conditions.

EASYSED IS A RECORD-KEEPING AND DATE-CALCULATION TOOL ONLY.

1. No Professional Advice: The Application, including all calculations, dashboards, qualifying period indicators, rule alerts, safe return date estimates, PDF summaries, and CSV exports, is provided solely for informational and organisational purposes. It does not constitute tax, accounting, legal, or financial advice.
2. HMRC Compliance & Rules: Tax laws and guidelines issued by HM Revenue & Customs (HMRC)—including rules governing the Seafarers’ Earnings Deduction (SED), the 183-day rule, the half-day rule, and qualifying periods—are subject to interpretation and change. easySED does not guarantee that your reliance on calculations generated by the App will result in HMRC approval of any tax claim.
3. Consult a Professional: You are strongly advised to consult a qualified tax professional, accountant, or tax adviser before filing any tax returns or submitting claims for the Seafarers’ Earnings Deduction.

1. Accuracy of Data: All output generated by easySED depends entirely on the accuracy, completeness, and honesty of the data entered by you (such as departure dates, arrival dates, vessel names, foreign port calls, and voyage details). You are solely responsible for verifying the accuracy of all information logged in the App.
2. Verification of Evidence: easySED allows you to store copies of documents (such as discharge book scans, boarding passes, and contracts). We do not review, verify, authenticate, or validate any evidence or documents you attach to your trips.
3. Audit Responsibility: In the event of an HMRC query, audit, or investigation, you remain solely responsible for maintaining original paper or verified digital records as required by UK tax authorities. easySED does not act as an official tax archive or legal custodian of your original documents.

1. Local Storage Architecture: easySED is designed as a privacy-first, local-device application. All data, trip logs, attached files, and settings are stored locally on your device. If you have iCloud or computer backups switched on, Apple may include this data in those backups.
2. No Central Database: We do not host, view, store, monitor, or maintain access to your trip data, evidence files, or tax exports on any central server.
3. Loss of Data: Because your data resides on your local device, we are not responsible for any loss of data, corrupt files, or unrecoverable records resulting from lost devices, software updates, app deletions, or hardware failures. You are solely responsible for using easySED’s built-in backup tools to back up your data to an external location (e.g., Files, iCloud, or external storage).

1. 12-Month Free Trial: Every new user receives 12 months of full access to all features at no cost, counted from the date your Apple ID first downloaded easySED. Reinstalling the App does not restart your free year. No payment information is required to start your free year, and you will not be charged automatically upon its conclusion.
2. Early Subscription: If you choose to purchase an auto-renewing subscription (Yearly or Monthly) during your free 12-month period, payment is charged immediately to your Apple ID account, and the paid subscription replaces the remainder of your free period.
3. Auto-Renewal & Cancellation: Subscriptions automatically renew unless cancelled in your Apple ID Account Settings at least 24 hours prior to the end of the current billing period. Account renewal charges occur within 24 hours prior to the end of the current period.
4. Read-Only Access: If your free trial or paid subscription expires without renewal, easySED transitions to Read-Only Mode. You will retain perpetual access to view your existing trips, view evidence, access your compliance history, and export Audit Packs and backup files, but logging new trips or editing records will be disabled until a subscription is active.
5. Refunds: All subscription transactions and refund requests are processed directly through Apple in accordance with Apple’s App Store refund policies.

THE APPLICATION IS PROVIDED TO YOU “AS IS” AND “AS AVAILABLE” WITH ALL FAULTS AND DEFECTS WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WITHOUT LIMITATION TO THE FOREGOING, WE PROVIDE NO WARRANTY OR UNDERTAKING THAT THE APPLICATION WILL MEET YOUR REQUIREMENTS, ACHIEVE ANY INTENDED RESULTS, BE COMPATIBLE WITH ANY OTHER SOFTWARE OR HARDWARE, OPERATE WITHOUT INTERRUPTION, MEET ANY PERFORMANCE OR RELIABILITY STANDARDS, OR BE ERROR-FREE.

Nothing in this Agreement affects your statutory rights as a consumer, including your rights under the Consumer Rights Act 2015.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL JORGE ANDREWS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, CONSEQUENTIAL, OR PUNITIVE DAMAGES WHATSOEVER (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, TAX PENALTIES, HMRC INTEREST CHARGES, BACK TAXES, OR BUSINESS INTERRUPTION) ARISING OUT OF OR IN ANY WAY RELATED TO THE USE OF OR INABILITY TO USE THE APPLICATION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN ANY CASE, OUR ENTIRE LIABILITY UNDER ANY PROVISION OF THIS AGREEMENT SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID BY YOU FOR THE APPLICATION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR TWENTY BRITISH POUNDS STERLING (£20.00 GBP), WHICHEVER IS GREATER.

Nothing in this Agreement excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited by law.

You agree to indemnify, defend, and hold harmless Jorge Andrews and any agents or contractors acting on our behalf from and against any and all claims, liabilities, damages, losses, costs, expenses, penalties, interest, or fees (including reasonable legal fees) arising from:

1. Your use of or reliance on the Application;
2. Any tax filing, claim, or audit submission made by you or on your behalf incorporating data or reports generated by easySED;
3. Your breach of this Agreement; or
4. Any inaccuracy or misrepresentation in the data or evidence you log or export using the App.

This Agreement shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law principles. Any dispute or legal proceeding arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales, except that if you are a consumer resident in Scotland or Northern Ireland, you may also bring proceedings in the courts of Scotland or Northern Ireland.

The following terms apply because easySED is distributed through the Apple App Store:

1. Acknowledgement: This Agreement is concluded between you and us only, and not with Apple Inc. (“Apple”). We, not Apple, are solely responsible for the Application and its content.
2. Maintenance & Support: We are solely responsible for providing any maintenance and support for the Application. Apple has no obligation whatsoever to furnish any maintenance or support services for the Application.
3. Warranty: To the extent any warranty has not been effectively disclaimed, if the Application fails to conform to it, you may notify Apple, and Apple will refund the purchase price (if any) for the Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be our sole responsibility.
4. Product Claims: We, not Apple, are responsible for addressing any claims by you or any third party relating to the Application or your possession and/or use of it, including (a) product liability claims; (b) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.
5. Intellectual Property: In the event of any third-party claim that the Application or your possession and use of it infringes that third party’s intellectual property rights, we, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of any such claim.
6. Legal Compliance: You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
7. Third-Party Terms: You must comply with any applicable third-party terms of agreement when using the Application.
8. Third-Party Beneficiary: Apple and Apple’s subsidiaries are third-party beneficiaries of this Agreement, and upon your acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary.
